Overview 

This website is operated by Fry Design Co, a residential design firm based in Guthrie, Oklahoma. In these Terms of Service ("Terms"), "Fry Design Co," "we," "us," and "our" mean Fry Design Co "You" means anyone who visits frydesignco.com (the "Site") or buys from us. The Site, our online store, our plans, and the information and tools we offer are our "Services." 

By visiting the Site or buying from us, you agree to these Terms and to the policies they reference, including our [Privacy Policy] and [Refund Policy]. If you do not agree, please do not use the Services. 

Custom home design and plan modification work is governed by the separate design agreement you sign with us. If that agreement conflicts with these Terms, the design agreement controls for that project. 

Our store is hosted on Shopify, which provides the e-commerce platform we use to sell plans to you. 

Plan License and Copyright 

Fry Design Co owns its designs 

Every Fry Design Co plan, drawing, rendering, 3D model, and plan name is original work owned by Fry Design Co and protected by U.S. copyright law, including protection for architectural works. When you buy a plan, you buy a license to use it. You do not buy the copyright. 

What a plan purchase allows 

Unless your order or design agreement says otherwise, buying a plan gives you a non-exclusive, non-transferable license to: 

  • Build one home from the plan, on one site. 

  • Make copies of the plans as needed to price, permit, finance, and build that one home. 

  • Share the plans with your builder, subcontractors, lender, engineer, and building department for that one home. 

  • Modify the plan for that one home, either with Fry Design Co or with a licensed professional. 

What a plan purchase does not allow 

  • Building more than one home from the plan without buying an additional license. 

  • Reselling, sharing, posting, or giving the plans to anyone for any other project. 

  • Copying or redrawing the plan, or creating a new plan based on it, for use outside your licensed home. 

  • Removing our name, copyright notice, or plan name from the drawings. 

  • Using our plan names, renderings, or photos to market another plan or business. 

If you would like to build the same plan more than once, or you are a builder or developer interested in multiple builds, contact us about a multi-build license. 

Using our plans or designs beyond the license is copyright infringement, and we take it seriously. 

Building From Our Plans 

Our plans are designed to be builder-ready, but every lot, region, and building department is different. Before you build, you and your builder are responsible for: 

  • Code compliance. Confirming the plans meet the building codes, zoning rules, and HOA or deed restrictions where you are building. Requirements vary by city, county, and state. 

  • Engineering. Hiring a licensed engineer where your jurisdiction requires one, including for foundations, structural framing, wind and snow loads, and soil conditions. Unless your order says otherwise, our stock plans are not engineered or stamped for your site. 

  • Site conditions. Adapting the plans to your lot, including grading, drainage, utilities, and septic. 

  • Checking dimensions. Reviewing all dimensions and details before construction begins and telling us about any errors or questions before work starts. 

  • Construction. Choosing a qualified builder. Fry Design Co does not build homes and is not responsible for construction quality, methods, or costs. 

Renderings, photos, and 3D walkthroughs show the design intent. Finishes, colors, furniture, landscaping, and some details may differ from the plans you receive. Square footage and dimensions are approximate and may vary slightly with construction methods. 

If your plans need changes to meet local requirements, we can help. Ask us about modifications. 

Using Our Store 

Eligibility 

By using the Services, you confirm you are at least the age of majority where you live. You agree not to use our plans or Services for any illegal or unauthorized purpose, including in violation of copyright law. 

Orders and pricing 

  • Plan prices, descriptions, and availability can change at any time without notice. We may discontinue any plan at any time. 

  • We may refuse or cancel any order, or limit quantities per person, household, or order. This includes orders that appear to be placed by resellers. If we change or cancel your order, we will try to contact you using the email or phone number on the order. 

  • Digital plans are delivered by download link after payment. Refunds and exchanges follow our [Refund Policy]. 

  • We work hard to show plans, renderings, and colors accurately, but we cannot guarantee your screen will display them exactly. 

Your account and billing information 

You agree to give us current, complete, and accurate information for every purchase and to keep your account details up to date. You are responsible for keeping your login information private. 

Errors on the Site 

The Site may sometimes contain typos, inaccuracies, or omissions in plan descriptions, pricing, or availability. We may correct errors, update information, or cancel orders if information is wrong, even after you have ordered. Information on the Site is for general reference and should not be your only basis for building decisions. Talk with your builder and local building department, or with us. 

Changes to the Services 

We may change, suspend, or discontinue any part of the Services at any time. We are not liable to you or anyone else for any change, price change, suspension, or discontinuation. 

Reviews, Feedback, and Submissions 

If you post a review or send us comments, ideas, or suggestions about our Site or plans ("Feedback"), you agree we may use, edit, and publish that Feedback without paying you or keeping it confidential. You are responsible for what you post. It must not violate anyone's rights or contain anything unlawful, abusive, or misleading. We may remove any content we consider inappropriate. 

This does not apply to the private project materials you share with us for a custom design, such as surveys, site photos, and budgets. We handle those under your design agreement and our [Privacy Policy]. 

Prohibited Uses 

You may not use the Site, our plans, or our content to: 

  • Break any law or encourage others to. 

  • Infringe our copyrights or other intellectual property, or anyone else's. 

  • Harass, abuse, threaten, or discriminate against anyone. 

  • Submit false or misleading information. 

  • Upload viruses or other harmful code. 

  • Collect other people's personal information. 

  • Scrape, crawl, or copy plans, images, or content from the Site. 

  • Interfere with or get around the Site's security features. 

We may end your use of the Services for violating any of these rules. 

Third-Party Tools and Links 

The Site may give you access to tools provided by others, and may link to other websites, such as social media platforms. We do not control them, provide them "as is," and are not responsible for their content, accuracy, or practices. Use them at your own discretion, and review their terms before you do. Questions about a third party's products or services should go to that third party. 

Personal Information 

How we collect and use your personal information is explained in our [Privacy Policy]. 

Disclaimer of Warranties 

We do not guarantee that the Site will be uninterrupted, timely, secure, or error-free. Except as we expressly state in writing, the Services and all plans are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. 

Limitation of Liability 

To the fullest extent the law allows, Fry Design Co and its owners, employees, contractors, and service providers are not liable for any indirect, incidental, special, punitive, or consequential damages, including lost profits, lost savings, construction delays, change orders, or replacement costs, arising from your use of the Services or any plan. This includes damages caused by construction methods, site conditions, code requirements, or engineering decisions made by you, your builder, or others. 

Our total liability for any claim related to a plan purchase will not be more than the amount you paid for that plan. Some states do not allow certain limits on liability, so some of these limits may not apply to you. 

Indemnification 

You agree to defend and hold harmless Fry Design Co and its owners, employees, contractors, and service providers from any claim or demand, including reasonable attorneys' fees, made by a third party because of your breach of these Terms, your misuse of our plans, or your violation of any law or the rights of others. 

General Terms 

Governing law 

These Terms are governed by the laws of the State of Oklahoma. Any dispute will be handled in the state or federal courts located in [Logan County], Oklahoma. 

Termination 

These Terms apply until ended by you or us. You can end them at any time by no longer using the Services. If you break these Terms, we may end your access without notice, and you remain responsible for any amounts owed. Your plan license obligations and these sections on copyright, liability, and indemnification continue after termination. 

Severability and entire agreement 

If any part of these Terms is found unenforceable, it will be enforced to the extent allowed and the rest of the Terms will stay in effect. Our failure to enforce any part of these Terms is not a waiver. These Terms, together with our posted policies and any signed design agreement, are the entire agreement between you and us about the Services. 

Changes to these Terms 

We may update these Terms at any time by posting changes on this page and updating the "Last updated" date. Please check back from time to time. Continuing to use the Services after changes are posted means you accept them.
